1. About the Tour

The Free Walking Tour (“the Tour”) is a guided walking experience in New York City operated by FunWalk NYC (“we,” “us,” “the Guide”).

The Tour is provided free of charge, and participants may choose to leave a voluntary tip at the end of the Tour.

2. Participation & Personal Responsibility

By joining the Tour, you acknowledge and agree that:

You are participating voluntarily and at your own risk
You are responsible for your own safety, health, and belongings
You understand the Tour involves walking on public streets, sidewalks, parks, and crowded areas
You confirm that you are physically able to participate and have no medical condition that would make participation unsafe.

3. Assumption of Risk

You understand and accept that walking tours may involve risks including, but not limited to:

Slips, trips, or falls
Traffic, bicycles, scooters, and other pedestrians
Weather conditions (heat, cold, rain, snow)
Crowded public spaces
Physical fatigue
You voluntarily assume all risks, known and unknown, associated with participation.

4. Limitation of Liability

To the fullest extent permitted by law:
FunWalk NYC and the Guide are not responsible for:

Personal injury
Illness or health-related issues
Accidents
Loss, theft, or damage to personal property
Damage to phones, cameras, or other electronic devices

This includes, but is not limited to, pickpocketing, dropped phones, broken devices, or stolen items.

5. Health & Medical Disclaimer

We do not provide medical advice or assistance.
By joining the Tour, you confirm that:

You are responsible for managing your own health conditions
You will bring any necessary medication, water, or assistance
You understand that emergency medical services, if needed, are your responsibility

6. Photography & Media

During the Tour, the Guide may take photos or videos of participants.

By participating, you grant permission for:

Your image to be captured during the Tour
Use of photos for marketing, social media, or promotional purposes

If you do not wish to appear in photos, you must inform the Guide before the Tour begins.

7. Minors

Participants under the age of 18 must be accompanied by a parent or legal guardian, who accepts full responsibility on their behalf.

8. Code of Conduct

We reserve the right to remove any participant who:

Behaves disrespectfully
Disrupts the Tour
Poses a safety risk to themselves or others

No refunds or compensation apply, as the Tour is free.

9. Changes & Cancellation

We reserve the right to:

Modify the Tour route
Cancel or end the Tour early due to weather, safety concerns, or unforeseen circumstances

10. Reservation Confirmation

To secure your reservation, participants must either accept the calendar invitation sent after booking or reply to confirmation emails.

If a participant has not accepted the calendar invitation and has not responded to confirmation emails at least 48 hours before the scheduled tour time, FunWalk NYC reserves the right to cancel the reservation and release the time slot to other guests without further notice.

11. Governing Law

These Terms shall be governed by the laws of the State of New York, USA.
